High Court stays Trial Court order in Kathua case
Srinagar: In the much publicized Rasana case, High Court has stayed the Trial Court order regarding registration of FIR against Special Investigation Team (SIT) members, Daily Excelsior reported.
The Trial Court vide order dated October 22, 2019 had directed SSP Jammu to register FIR against R K Jalla (Ex- SSP Crime Branch, Jammu), Peerzada Naveed, (Addl Superintendent of Police Crime Branch, Jammu), Shetambari Sharma ( DySP Crime Branch Jammu), Nassir Hussain, (DySP Crime Branch Jammu), Urfan Wani and Kewal Kishore.
After hearing Senior Advocate PN Raina with Advocate JA Hamal for the petitioners, Justice Tashi Rabstan issued notice and ordered that subject to objections from the other side, operation of the impugned order passed by Trial Court, shall remain stayed.
The order has been passed in a petition filed by Ramesh Kumar Jalla and others, who were aggrieved over the order passed by the Trial Court for registering the FIR against them.
Senior Advocate PN Raina appearing for the petitioners submitted that the order impugned was contrary to the provisions of Code of Criminal Procedure inasmuch as the Trial Judge has without directing enquiry to be conducted into the matter in terms of Section 156(3) CrPC, directed the SSP, Jammu to register the FIR against the petitioners in the relevant provisions of law, Daily Excelsior reported.
